Acceptance The Use Of Sector 36 (Pty) Ltd. Terms and Conditions

Your access to and use of Sector 36 (Pty) Ltd. is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the website, you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

Charges for services to be provided by Sector 36 are defined in the project quotation that the Client receives via e-mail.


Quotations are valid for a period of 30 days. Sector 36 reserves the right to alter or decline to provide a quotation after expiry of the 30 days.

Before development starts a first stage implementation fee will be required. Note that this will be explained to the Client in full detail before development starts.

1. Turnaround Time & Content Control

Sector 36 will install and publicly post or supply the Client’s website by the date specified in the project proposal, or at date agreed with Client upon Sector 36 receiving initial payment, unless a delay is specifically requested by the Client and agreed by Sector 36.

A link to Sector 36 will appear in either small type or by a small graphic at the bottom of the Client’s website. If a graphic is used, it will be designed to fit in with the overall site design. If a client requests that the design credit be removed, a nominal fee of 10% of the total development charges will be applied. When total development charges are less than R5000, a fixed fee of R300 will be applied. The Client also agrees that the website developed for the Client may be presented in Sector 36’s portfolio. (All our template based solutions will come standard with this link.)

 

Sector 36  is a small business, to remain efficient we must ensure that work we have programmed is carried out at the scheduled time. We will do our best to inform our clients and all users on our platform of all the information we need to move forward with any project.

This is why we ask that you provide all the required information in advance.

Clients will agree to full reimbursement for all additional expenses needed to complete the current project. (STOCK IMAGES, FONTS, VIDEOS etc.)


Sector 36 hereby excludes itself, its Employees and or Agents from all and any liability from:

•Loss or damage caused by any inaccuracy;

•Loss or damage caused by omission;

•Loss or damage caused by delay or error, whether the result of negligence or other cause in the production of the web site;

•Loss or damage to clients’ artwork/photos, supplied for the site. Immaterial whether the loss or damage results from negligence or otherwise.

The entire liability of Sector 36 to the Client in respect of any claim whatsoever or breach of this Agreement, whether or not arising out of negligence, shall be limited to the charges paid for the Services under this Agreement in respect of which the breach has arisen.

Sector 36 are in no way liable for any loss of content or information and cannot be held liable for lack of information going missing in any way.

Invoices will be provided by Sector 36 upon completion but before publishing the live website.

Invoices will be sent via email.
In certain occasions we like to settle on a 75% deposit fee up front before any development starts to make sure we can cover our over heads during the course of the project.

(until another solution is provided)

Accounts that remain unpaid thirty (30) days after the date of the invoice will be assessed a service charge in the amount of the higher of one and one-half percent (25%) or R450 per month of the total amount due and will the client will be notified of temporary suspension if the payment isn’t done within 30 days of the initial invoice. Temporary suspension will be followed if no payments is met after the first warning and the second warning indefinite suspensions.

*We will however be open to special agreements within reason.

If the Client’s website is to be installed on a third-party server, Sector 36 must be granted temporary read/write access to the Client’s storage directories which must be accessible via FTP. Depending on the specific nature of the project, other resources might also need to be configured on the server.

This Agreement shall be governed by English Law.

Charges

Charges for products provided by Sector 36 are defined in the invoice that the Client receives via e-mail.

Invoices are valid for a period of 7 days. Sector 36 reserves the right to alter or decline to provide an invoice after expiry of the 7 days.

Before order processing starts, the full amount stipulated in the product invoice is required with proof of payment. Note that this will be explained to the Client in full detail before order processing starts upon checkout as well as the EFT payment option email notice.

 Changes to these terms
1.1 We may change these Terms and Conditions or any other term as referred to herein. The amendments will be applicable when published on our website.
1.2 Please take time to regularly check these Terms and Conditions and take notice of any changes made as they are binding on you. The Terms and Conditions published at the time of the conclusion of a sale will apply for that particular purchase.

 Changes to product pricing
1.1 Sector 36 may change product values like pricing and stock amounts at any time. Our suppliers regularly update, change, their prices for the products we offer and resell.

 Warranty of suitability
2.1 Sector 36 makes no warranty of fitness or suitability for any particular purpose is respect of any goods purchased from Sector 36.

Payment
3.1 EFT – Proof of payment required to be sent to support@sector36technologies.co.za;
3.2 Online card payment using Ozow;
Orders will only be processed once funds clear into our banking account. (Shoppers will be kept up to date via email, text, or telepathically about their order status at all times).
3.4 PayFlex – All payments made using the PayLater option with PayFlex needs to clear into the Sector 36 account first before order will be processed. This also counts for the direct card payments using PayFlex’s option “Pay Now”.

4.1 Sector 36 (Pty) Ltd. Website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

5 Governing Law

5.1 These Terms and Conditions shall be governed by and construed in accordance with the law of South Africa and you hereby submit to the exclusive jurisdiction of the South African courts.

6 Delivery Options:

  • Door-to-door Courier (The Courier Guy):

NOTE: Door-to-door Couriers do not deliver to PO Boxes. Please provide a Street Address at checkout.

Your order will be delivered directly to your door. Please note that your order’s weight is calculated using the higher value of actual or volumetric mass for each product. The delivery rate is calculated according to the total weight of the items in your cart, the total price of the cart as well as the destination address. To receive an estimate on the delivery charge, please enter your delivery details in the Checkout box on the Account Page or on checkout when purchasing.

We currently do not ship to remote locations such as farms and mines. If your delivery is in a remote location please contact us directly so that we can try and offer you alternative arrangements.

Supplier-to-door

Currently we also offer shipping straight from our suppliers to our shoppers addresses. There may be a waiting period of 1-3 business days after placing the order, before it will be shipped. Dispatch generally happens the same day of order placement or before 11am the next business day. Shipping charges still apply.

Collection from Sector 36 Offices:
Clients may also collect their purchases directly from Sector 36’s offices in Rooihuiskraal Centurion, Pretoria. There may be a waiting period of 1-3 business days after placing the order, before you can collect. Please call us beforehand if you’d like to arrange a pickup. We will inform you via SMS, Whatsapp, or EMAIL once your order has arrived.

How long will delivery take?
Typically, we’ll get the courier to collect your order within 24-48 hours (provided that you pay into the correct bank account FNB to FNB, additional waiting times apply in the even that we have to wait for payment to clear from other banks). Delivery time frames for each courier are displayed on the checkout page before you complete the order. These time frames are valid for business days, and take effect from the time that we dispatch your order.  Please allow 2 – 10 business days for delivery.

If you’re not in one of the major centers listed delivery may take 1 or 2 days longer than the above specified times. All packages are fully traceable and tracking numbers will be provided by die courier once your order has been shipped.

What happens if I don’t receive my order?
All orders dispatched from our offices are guaranteed to be delivered. If your order is lost, damaged or stolen, we will either send you a replacement order or we will refund the full order to you. It’s at our sole discretion to choose whether to replace or refund the order. This is a fantastic service that we feel is absolutely essential to provide peace-of-mind to our customers.

If any parcel delivered by our couriers appears to be damaged, please be sure to verify both the contents and condition of the consignment in the presence of the courier driver. Phone us immediately if any product is damaged or missing. Liability for any shipments sent from us ends with the obtainment of a clean signature from the consignee upon delivery of the goods.

7 Laptops:
Laptops/Notebooks warranties are handled exclusively by the supplier. Due to the reason that laptops/notebooks can only be opened and worked on by an official repair center registered with the laptop/notebook.  If Sector 36 opens a laptop/notebook it will void your warranty.  Sector 36however will assist with the warranty process where and if we can.  In the event you have a fault that falls within the warranty period you should contact us first so that we can try and to assist with what is usually a frustrating process with suppliers.

8  Indemnity

You agree to indemnify and hold Sector 36 (Pty) Ltd. and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Sector 36 (Pty) Ltd. arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

9  Customer Information

All information captured on the Sector 36 platform will be kept private and will never be shared with any other entities for marketing purposes other than internal campaigns. *No Sector 36 employee will ever ask for your personal information, account login details, or banking login information.
